Public Holiday conversion to Annual leave - from 1 April 2012
Agreement between NHS Grampian and the BMA Local Negotiating Committee to convert additional public holiday entitlement to additional annual leave entitlement.
1.0 The basis for this agreement is General Whitley Council Handbook Section 2 – Statutory and Public Holidays which applies to Medical and Dental Staff. It states:
“Whole-time employees shall be entitled to ten paid statutory and public holidays a year. Employing authorities should decide, in the light of local practice and in accordance with the needs of the service after consultation with representatives of the employees concerned on which days the holidays are to be taken. …..The designated days shall be the same for all groups of employees in each major unit of the employing authority. As an alternative to this, the two additional days may be converted to a period of annual leave, after agreement between the employing authority and staff and local staff representatives, in any way which does not lead to a detrimental outcome overall for any individual member of staff.’
2.0The BMA LNC and NHS Grampian hereby agree that in addition to the annual leave entitlement set out in the national terms and conditions of service, all doctors and dentists employed by NHS Grampian are entitled to 10 days public holidays, 8 of which will correspond with the public holidays of other NHS staff employed by the board, and 2 of which will be converted to a period of 3 days additional annual leave with effect from 1st April 2012.
3.0This agreement shall remain in effect on an ongoing basis unless and until a nationally negotiated settlement supersedes it.
4.0The basis for taking the three days of additional annual leave shall be the same as for the pre-existing annual leave entitlement of medical and dental staff. For clarity, the premium payments entitlement (4.1.8 and 4.8.1 of the consultant contract) will not apply to these 3 days of annual leave in lieu of 2 public holidays, but will continue to apply for other public holidays in line with the consultant contract.
5.0For medical and dental staff who are working less than full time or for part of the year in NHS Grampian the following table of entitlement shall apply:

6.0For permanent medical and dental staff joining part way through a given leave year their entitlement shall be calculated on the basis of the remaining leave year (calculated to the nearest whole month) at point of appointment from the above table.
7.0Transitional Arrangements for applying 3 annual leave days in exchange for 2 public holidays shall apply in respect of current medical and dental staff whose leave year does not run from 1st April 2012. For this group for the remainder of the leave year in which April 1st 2012 falls, a proportional addition of annual leave entitlement will be applied (based on a WTE) as detailed below: - .
i.Current Leave year ending 1-30 April 2012 - no additional days in current leave-year.
ii.Current Leave year ending 1 May – 30 June 2012 - 1 additional days in current leave-year.
iii.Current Leave year ending 1 July - 31 August 2012 - 2 additional days in current leave-year.
iv.Current Leave year ending 1 Sept 2011 – 31 March 2013 - 3 additional days in current leave-year.
